This Privacy Policy explains how ElderNote and Myers Medical, LLC (“Company,” “we,” “our,” or “us”) collect, use, store, disclose, and protect information when you use the ElderNote website, mobile application, web application, software, and related services collectively referred to as the “Service.”
By using ElderNote, you agree to this Privacy Policy. If you do not agree, do not use the Service.
ElderNote is designed to help authorized caregivers, healthcare professionals, facility staff, and care team members organize, document, and track information related to elderly residents and patients.
The Service may include features for resident profiles, care notes, medication tracking, health observations, task reminders, care team collaboration, and related administrative or clinical support.
ElderNote is not intended for emergency use.
Depending on how you use ElderNote, we may collect the following types of information.
We may collect information used to create and manage your account, including:

Organization or facility name
Job title or role
Login credentials

Subscription or billing status
Users may enter information about residents, patients, or individuals under care, including:

Date of birth

ElderNote does not independently verify medication or health information entered by users.

If ElderNote offers paid subscriptions, payment may be processed by a third-party payment processor. We may receive limited billing-related information, such as subscription status, payment confirmation, billing email, and transaction identifiers.
We do not intend to store full credit card numbers on our own servers unless specifically disclosed.

Provide and operate ElderNote.

ElderNote may be used in settings involving health information, including information that may qualify as protected health information, or PHI, under HIPAA.
When ElderNote is used by or on behalf of a HIPAA-covered entity or business associate to create, receive, maintain, or transmit PHI, ElderNote may be acting as a business associate under HIPAA. In those situations, use of ElderNote with PHI may require a written Business Associate Agreement between Myers Medical, LLC and the applicable covered entity or business associate before PHI is entered into the Service.
ElderNote may use third-party service providers, including cloud, hosting, analytics, security, AI, or infrastructure providers, to operate the Service. Where required, we will maintain appropriate written agreements, including Business Associate Agreements or subcontractor agreements, with vendors that create, receive, maintain, or transmit PHI on our behalf.
If ElderNote uses OpenAI services to process PHI, that use will be governed by the applicable agreement between Myers Medical, LLC and OpenAI, including any Business Associate Agreement, data processing terms, and product-specific usage restrictions.
If a Business Associate Agreement applies and conflicts with this Privacy Policy, the Business Associate Agreement will control with respect to PHI.
Some health apps may not be covered by HIPAA but may still be subject to federal or state privacy laws. Several states have enacted or expanded laws addressing consumer health data, including requirements related to consent, notices, rights to access or delete data, and limits on sharing health-related information.
We will attempt to comply with applicable privacy laws based on the nature of the Service, the information collected, and where users reside.
We may share information only as described below.
Information entered into ElderNote may be visible to other authorized users within the same account, facility, organization, care team, or resident profile, depending on permissions and account settings.
We may share information with vendors that help us operate ElderNote, such as:
Cloud hosting providers
Database providers
Authentication services
Customer support tools
Analytics or crash-reporting tools
Payment processors
Email or notification services
Security and monitoring tools
These vendors may only use information as needed to provide services to us.
Some service providers may process health information, including PHI, on our behalf. Where required by law, we will enter into appropriate written agreements with such providers, including Business Associate Agreements or subcontractor Business Associate Agreements.
If your account is provided by or associated with a facility, employer, healthcare practice, or organization, that organization may have access to account activity, user information, and data entered under its account.
We may disclose information if we believe it is reasonably necessary to:

Respond to government or regulatory requests.
Protect patient, resident, user, or public safety.
Investigate fraud, abuse, or security incidents.

We do not sell personal information or personal health information.
We also do not use resident or patient health information for third-party advertising.

However, no system is completely secure. We cannot guarantee that unauthorized access, hacking, data loss, or misuse will never occur.
Users are responsible for maintaining secure passwords, protecting devices, limiting access to authorized users, and promptly reporting suspected unauthorized access.

Resident, patient, or health information may be retained according to the settings, subscription plan, organization requirements, legal obligations, or any applicable written agreement.

Requests to access, correct, export, or delete resident or patient information may need to be directed to that organization.
ElderNote is intended for use by adults and authorized professionals or caregivers. It is not intended for use by children under 13.
We do not knowingly collect personal information directly from children under 13. If we learn that we have collected information directly from a child under 13 without appropriate consent, we will take reasonable steps to delete it.
If ElderNote is available through the Apple App Store, Google Play, or another app marketplace, we may be required to provide platform-specific privacy disclosures. Apple requires developers to provide privacy information about data collection and use for App Store listings.

ElderNote may contain links to third-party websites or integrate with third-party services. We are not responsible for the privacy practices, security, content, or policies of third parties.
Your use of third-party services may be governed by separate terms and privacy policies.
ElderNote is intended primarily for users in the United States unless otherwise stated.
If you access ElderNote from outside the United States, you understand that your information may be processed and stored in the United States or other locations where our service providers operate.
If we discover a security incident involving personal information or health-related information, we will investigate and provide notices as required by applicable law.
Depending on the nature of the Service and the information involved, federal or state breach notification laws may apply. The FTC Health Breach Notification Rule may apply to certain health apps that are not covered by HIPAA.
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date.
If changes are material, we may provide notice through the Service, by email, or on our website.
